Terms of use (ToU)

The ZYNHA platform is published by:

ZYNHA is a digital platform that allows owners and managers of short-stay rentals to centralize, coordinate and supervise their rental operations.

The services offered include in particular:

• booking synchronization,
• organization of operational missions,
• connection with independent service providers,
• service tracking,
• operational management,
• communication tools,
• dashboards and automations.

ZYNHA acts exclusively as a technology and orchestration platform.

Use of the platform implies full and unreserved acceptance of these ToU.

Every user acknowledges having read and understood these terms before any use of the services.

The user is responsible for:

• the accuracy of the information provided,
• the confidentiality of their credentials,
• any activity carried out from their account.

ZYNHA reserves the right to suspend or delete an account in case of:

• fraud,
• abusive use,
• non-compliance with these terms,
• behavior that harms the platform or other users.

Service providers on ZYNHA operate as independent workers.

No employment, agency or representation relationship exists between ZYNHA and the providers.

Each provider remains solely responsible for:

• their services,
• their tax obligations,
• their insurance,
• their administrative filings,
• compliance with local regulations.

ZYNHA makes reasonable efforts to ensure the availability of its services.

However, the platform is provided “as is” and without any warranty of uninterrupted operation.

ZYNHA does not guarantee:

• the absence of errors,
• permanent continuity of service,
• uninterrupted availability,
• compatibility with all devices or third-party platforms.

ZYNHA may interact with third-party platforms such as Airbnb, Booking.com or other external services.

ZYNHA is not responsible for:

• changes to those platforms,
• interruptions of their services,
• technical limitations they impose,
• errors originating from their systems.

To the extent permitted by applicable law, ZYNHA cannot be held liable for:

• indirect financial losses,
• loss of business,
• loss of bookings,
• disputes between users,
• damage caused by a service provider,
• service interruptions,
• incorrect data provided by users.

ZYNHA's total liability shall not exceed the amount paid by the user during the previous three months.

All elements of the ZYNHA platform are protected by intellectual property laws.

Any unauthorized reproduction, copy or exploitation is prohibited.

The user may delete their account at any time.

ZYNHA may suspend or terminate an account in case of:

• fraud,
• breach of these terms,
• abusive use,
• compromise of the platform's security.

These ToU are governed by the laws of the State of New Mexico, United States.

Any dispute shall fall under the jurisdiction of the competent courts of New Mexico.
